  • Exemptions: Certain exemptions apply, such as for workers in specific industries or those covered by collective bargaining agreements that stipulate different break rules.
  • On-Duty Breaks: Under certain conditions, an “on-duty” meal break is permissible if the nature of the work prevents an employee from being relieved of all duties and if the employee and employer agree in writing. This agreement must state that the employee may, in writing, revoke the agreement at any time.
  • Suitability: Employers are also required to provide suitable resting facilities during work hours in an area separate from the bathroom facilities.
