Biography

Sean Hardy is a dedicated associate attorney at Matern Law Group. He represents individual employees who have suffered unlawful discrimination, harassment, and wrongful termination. He also represents employees in class-action wage and hour cases.

Sean has extensive experience representing individuals in harassment, discrimination, retaliation, and wrongful termination lawsuits. For over five years, he has exclusively handled plaintiff’s side cases, fighting for California’s workers. Sean firmly believes everyone deserves to be treated fairly. He takes pride in his position as an advocate for people who have been used, abused, or mistreated by their employers. He finds inspiration in his clients and those in need and tirelessly works to protect them from being taken advantage of by unlawful practices and bad actors. Sean understands the challenges his clients face and enjoys the opportunity to help them reclaim their agency. Sean leverages his knowledge and background to fight for a just result for employees subjected to abusive and unlawful practices of their employers.

During his career, Sean secured a win for his clients in a published opinion issued by the California Court of Appeals—2nd District, Gamboa v. Northeast Community Clinic (2021) 72 Cal. App. 5th. Sean represented the plaintiff, Hope Gamboa, who was fired from her job as a scanner after requesting a reasonable accommodation for a hand injury she suffered while working for Northeast Community Clinic. She filed a lawsuit against the Clinic, but the Clinic tried to dismiss the lawsuit and force her to arbitrate the dispute instead. The Clinic failed to produce sufficient evidence that Hope had signed a binding arbitration agreement during the onboarding process. The court ultimately agreed with Hope and disagreed with the Clinic. Because of Sean’s work and dedication to workers’ rights, Hope did not have to resolve the dispute with her employer in arbitration.

Sean understands the significance of these types of issues. Where the parties address the dispute can significantly affect how they resolve the disagreement. When workers’ rights are at stake, he will fight to help employees avoid resolving disputes in arbitration.

When he isn’t fighting for justice for his clients, Sean is usually long-distance running or spending time with his friends and family. He is also an avid outdoorsman and enjoys spending time camping and fishing in the beautiful settings that California has to offer.
